The violence associated with the so-called War on drugs has caught the attention of the international community over the past few years. In September 2014, the International Federation of Human Rights submitted a request to the Prosecutor of the International Criminal Court to investigate, in a complementary way, the alleged commission of crimes against humanity in Mexico during the Felipe Calderon’s administration (2006-2012). Facing this scenario, this work studies the relevance of classifying the War on drugs such as internal armed conflict under the standards of international law. After that, it discusses the hypothetical application of the typology “crimes against humanity” to the previously indicated period. Finally, it details the major problems of using this figure in the Mexican case.
