Projects requiring land and involving resettlement are complex, posing high risk from a social management and safeguard perspectives. The complexities are compounded by geographical location, political conditions, social stratification, legal safeguards, and overall institutional capacities of the countries in which the projects are planned and implemented. In Afghanistan, there are two extant statutes applicable to a public interest project requiring land. However, these are yet to be in effect due to the absence of mandated procedures and regulations. This study examines critical gaps in the existing legal framework and practices for land acquisition, resettlement, and rehabilitation (LAR and R) and donation and transfer of public land in Afghanistan in terms of World Bank policies and guidelines and relevant international best practices. This gap analysis is aimed to help develop a set of toolkits and handbooks to guide practitioners in implementing the LAR and R to offer simplified procedures and monitoring systems for efficient and timely achievement of implementation of land acquisition, transfers, donations, and rehabilitation and resettlement (R and R) in projects. This analysis would also support capacity-building initiatives for implementation of World Bank safeguards among officials engaged in land acquisition across various types of development projects. Thus, the diagnostic study aims to bridge the gap between the LAR and R framework in Afghanistan and the World Bank policies.
