Abstract: The purpose of this study is to minutelyanalyze the legitimacy provided to thePublic Defender´s office by law 11.448/2007,for filing Public Civil Actions, in the light of aconstitutional doctrine. The reason for choosingsuch topic is the importance of this institutionfor a greater access to justice and in theguarantee of The Democratic State of Law.The article also discusses the legal role of otherinstitutions, such as the Public Prosecutor´soffice, to file civil public actions and to builda more just legal system. This article has profitedfrom analyses from other areas of humanknowledge, such as Constitutional Law, Civiland Criminal Procedure Law and Legal Sociology
